Divorce Attorney and Mediator — Why Do You Need Both?
Divorce is a complex process that requires not only strong legal representation but also a thoughtful and sensitive approach to the emotional and financial needs of both parties. As a divorce attorney and mediator, I provide two complementary services: full legal representation and objective conflict resolution aimed at reaching an agreement that avoids lengthy and costly litigation.
With decades of experience in family law, divorce, financial agreements, custody, and asset division, I have learned that couples who successfully reach an agreement with the help of a skilled mediator save time, money, and additional harm to their children. However, when the parties cannot agree, appropriate legal representation is essential.
My boutique firm in Ramat Gan offers two pathways: guided mediation, in which I help the couple reach an agreement on their own in a safe environment, and full legal representation in family court when the divorce becomes contentious or the situation is tense.
What Are Uncontested Divorces?
Uncontested divorces are a process in which both spouses agree on all terms — asset division, child custody, alimony, health insurance, and more — without court intervention. They are faster, less expensive, and less traumatic than contested divorces.
To reach an agreed-upon settlement, both parties must have complete and accurate information about assets, income, liabilities, and their family's needs. This is where my role as an attorney comes in: I help each party understand their rights, review draft agreements, and protect their interests, even when discussions are conducted with the help of a mediator.
What Is Mediation in Divorce?
Mediation is a process in which a neutral third party (the mediator) helps both parties communicate, understand each other, and reach an agreement. The mediator is not a judge and does not make decisions — they assist in the process. When I serve as a mediator, I maintain a neutral position and have an ethical duty not to favor one side.
Mediation works best when:
- Both parties want an agreement and are not interested in litigation
- There are communication issues but no significant violence or threats
- Both parties can participate in discussions in each other's presence or separately
- There is a genuine desire to protect children above the conflict
The mediation process typically lasts several weeks to months, depending on the scope of the dispute and the complexity of assets. For lower costs than full litigation, couples achieve greater control over the outcome.
When Do You Need an Attorney in Addition to a Mediator?
Even when I serve as a mediator, each party can (and should) consult with their own attorney. This ensures that each party understands their full rights and the implications of their agreement. Additionally, after mediation concludes, I can serve as your attorney to update the land registry, file a request for court approval of the agreement, and perform any additional legal actions.
In cases where the divorce becomes contested — meaning one or both parties are not interested in an agreement or there are deep-rooted conflicts — I serve as full legal counsel, representing you in family court, managing the legal file, and investigating to protect your rights.

Comparison: Uncontested Divorce vs. Contested Divorce
Choosing between mediation with a mutual agreement and full litigation is a strategic decision that will impact the time, expenses, emotional stress, and your future relationship with your spouse. Below is a comparison of the two paths:
| Criterion | Uncontested Divorce / Mediation | Contested Divorce / Litigation |
|---|---|---|
| Duration | 2–6 months typically | 1–3 years or more |
| Estimated Cost | ₪15,000–₪50,000 total (depending on scope) | ₪80,000–₪300,000+ (attorney fees, investigations, appraisals) |
| Control Over Outcome | High — the parties decide | Low — the judge decides |
| Privacy | Complete — proceedings are closed | Partial — court is open to the public |
| Impact on Children | Generally lower — less stress | Generally higher — children as witnesses, stress |
| Future Relationships | Generally better | Often strained |
| Flexibility of Agreement | High — can be updated easily | Requires new litigation to modify |
How I Serve as Attorney and Mediator
My role as attorney and mediator changes depending on the stage of the process and the parties' wishes:
Stage 1: Initial Consultation
I meet with you separately to understand the situation, needs, concerns, and existing agreements (if any). I will explain your rights, the legal options available to you, and the expected outcomes in each scenario. At this stage, you can decide whether to attempt mediation or proceed directly to legal representation.
Stage 2: Mediation (If You Choose This Path)
I organize joint or separate meetings (shuttle mediation) in which I help both parties discuss critical issues: custody, alimony, property division, and other matters. I maintain complete neutrality while using my legal knowledge to guide discussions toward a fair and sustainable resolution.
Stage 3: Draft Agreement
After agreement on the terms, I prepare a comprehensive divorce agreement that includes all legal details: custody, visitation rights, alimony, property division, health insurance, capital gains tax, and additional provisions. Each party may consult with their own attorney before signing.
Stage 4: Court Approval
I submit the agreement to the Family Court for official approval. Typically, courts approve fair and lawful agreements without much scrutiny. Once approved, the agreement has full legal force.
Stage 5: Full Legal Representation (If Mediation Fails)
If mediation fails at any point or one party refuses an agreement, I transition to the role of representing counsel only. I manage a complete legal case, file motions with the court, conduct investigations, commission appraisals, and defend your rights before the judge.
Critical Issues in Divorce — Legal Advice
Every divorce is unique, but there are issues that recur in every case. Below are explanations of the most important topics:
Custody and Parental Rights
Custody is the most sensitive issue in divorce. The Family Court decides on custody based on the best interest of the child — it is not automatic that the mother will receive custody or the father. Typically, joint custody is the focus, but if one parent is unable or unavailable, sole custody may be fair. I help parents establish long-term custody arrangements that protect children and support the relationship with both parents.
Child Support and Financial Security
Child support is a monthly payment made by one parent to the other to support the children. The Child Support Law has been recently updated and sets out guideline tables, but living costs, children's needs, and paying capacity vary. I calculate fair child support according to your specific data and my experience with case law on child support modifications.
Property Division — Homes, Pensions, and Savings
Property division in divorce is a complex legal domain. Homes, occupational pensions, investment funds, family businesses, and liabilities (mortgages, loans) must be appraised, updated, and divided fairly. Often, one party conceals assets or values them incorrectly. I conduct legal discovery, commission independent appraisals, and protect your rights to the maximum.
Capital Gains Tax and Registration Fees
When a home is divided in divorce, there may be tax consequences. Capital gains tax may apply if the home increased in value. Registration fees and land registry fees vary according to the data. I consult with tax analysts and ensure the division is done in the most tax-efficient manner.
Health Insurance and Legal Safeguards
In divorce, it is important to clarify in the agreement who will be responsible for the children's health insurance, who pays for uncovered treatments, and how details are updated. Future modifications of custody, child support, or property division should also be clearly drafted to prevent future disputes.
Enforcement of Agreement
After the agreement is approved by the court, it becomes an order with full legal force. If one party breaches the agreement (for example, fails to pay child support or refuses visitation rights), the other party can file an enforcement motion with the court.
Frequently Asked Questions — Divorce Attorney and Mediator
Why Choose an Experienced Divorce Attorney and Mediator?
Divorce is one of the most important decisions in life. Choosing an experienced attorney and mediator can significantly impact the outcome, costs, and your path forward. Here's why it matters:
Experience in Family Law and Divorce
With decades of experience in family law, divorce, prenuptial agreements, custody, property division, and wills, I have seen nearly every scenario. I understand prevailing case law, the practices of the Family Court in Ramat Gan and the surrounding area, and the practical ways to achieve a fair and enforceable agreement. This experience allows me to provide accurate counsel and guide you wisely through a complex process.
Integrated Approach: Representation and Mediation
By serving as both attorney and mediator, I can offer an integrated approach that begins with mediation and returns to legal representation if necessary. This allows you to attempt reaching an agreement at lower cost, while knowing that if mediation fails, you have a strong attorney on your side. This flexibility saves considerable time and money compared to attorneys who only represent clients.
Discretion and Confidentiality
Divorce is a personal matter, and it's clear you want it to remain private. The mediation process is typically closed and confidential — it does not take place in open court. I maintain complete discretion at every stage, and everything said in mediation sessions is confidential and protected from legal discovery.
Personal and Legal Support
Divorce can be an emotional and difficult process. I provide not only legal counsel but also personal support — I listen to your concerns, explain options clearly, and support you in difficult decisions. I believe a good attorney should also be a trusted and honest advisor.
Protection of Rights and Custody
Whether through mediation or full legal representation, my role is to protect your rights — child custody, fair property division, fair spousal support, and financial security. I will not let you agree to anything just to end the process; I will ensure the agreement is fair and enforceable.
