Divorce Agreement Attorney — Why Is It Important?

A divorce agreement is one of the most important documents you will sign in your lifetime. It not only terminates your marriage legally — it determines your financial rights, child custody, visitation rights, and alimony obligations for years to come. A divorce agreement signed without professional legal counsel can leave you in a significant legal and financial disadvantage.

As a divorce attorney specializing in divorce agreements, I help my clients understand all the implications of the divorce agreement, protect their rights, and achieve a fair and legally strong agreement. Whether you are in the early stages of negotiation, have a draft agreement, or are dealing with the validity of an existing agreement — I am here to support you.

What Does a Divorce Agreement Include?

A divorce agreement is a legal document that regulates all matters related to the termination of marriage. It is legally binding and enforceable, and typically requires court approval before it takes effect. The agreement should contain clear and focused provisions regarding each of the following issues:

  • Property Division: Fair division of shared assets, including homes, bank accounts, investments, and savings. This is one of the most complex issues, especially when there are substantial assets or a shared business.
  • Alimony: Monthly payment from one party to the other, according to income, needs, and age. Spousal support and division of child expenses are precise legal calculations.
  • Child Custody and Care: Determining where children will live, visitation rights, division of educational decisions, and medical care responsibilities.
  • Financial Agreements: Regulation of debts, shared loans, life insurance, and payment arrangements.
  • Tax and Reporting Arrangements: Provisions regarding tax eligibility, deductions, and division of tax benefits.

Divorce Agreement Process — Steps and Expectations

Understanding the legal process helps you be prepared and avoid surprises. Here is an overview of the typical steps in a divorce agreement proceeding in Israel:

Step 1: Initial Legal Consultation

In your first meeting with me, we discuss your circumstances — how many years you have been married, whether there are children, significant assets, or questions regarding a joint business. I explain your rights under the Divorce Law, what you can expect, and how we will work to protect your interests.

Step 2: Collection of Financial Information

A divorce agreement requires full transparency of all assets, income, and liabilities. This includes houses, bank accounts, investments, pension funds, educational savings, and anything else of economic value. We help you gather all necessary documents and analyze them to understand the complete picture.

Step 3: Negotiation or Filing an Application

Typically, we first attempt to reach an agreement through direct negotiation between the parties or with their attorneys. This is faster, less expensive, and avoids court proceedings. If negotiation fails, we can file an application with the Family Court.

Step 4: Preparation of the Final Agreement

Once an agreement is reached, we prepare the final draft of the divorce agreement. The document must be legally precise, clear, and legally enforceable. Each provision is reviewed carefully to ensure there are no ambiguities or gaps that could lead to future disputes.

Step 5: Court Approval

The agreement is submitted to the Family Court. We prepare all necessary documents, including an affidavit, and a general overview of the agreement's terms. Typically, the court will hold a brief hearing to verify that the parties agree freely and without pressure. If everything is in order, the court will issue the final divorce order.

Step 6: Implementation of the Agreement

After the final order is issued, the parties begin to implement the terms — transfer of assets, payment of maintenance, custody arrangements, and visitation. We assist our clients in ensuring smooth and trouble-free implementation.

How Long Does It Take?

If there is an agreement between the parties, the process can be quick — sometimes a few weeks. If there are significant disputes, it can take months. Our office works to expedite the process as much as possible while maintaining the quality of your legal protection.

Property Division in Divorce — How Does It Work?

One of the most complex issues in a divorce agreement is property division. In Israel, the Divorce Law stipulates that assets accumulated during marriage are considered joint property, even if they were purchased in the name of only one spouse. This means that typically, both parties are entitled to an equal share of these assets.

What is Considered Joint Property?

  • Houses and Apartments: If purchased during marriage, even if in the name of one spouse.
  • Bank Accounts and Savings: Money accumulated during marriage.
  • Investments and Securities: Stocks, bonds, mutual funds.
  • Pension Fund and Insurance: Rights in pension funds and life insurance policies accumulated during marriage.
  • Joint Business: If one or both spouses own a share in a business that started or grew during marriage.
  • Real Estate Property: Land, buildings, or rights in real property.

What is Not Considered Joint Property?

There are exceptions. Assets purchased before marriage, or those acquired through inheritance or as a gift during marriage, may be considered personal property. However, if the personal asset was used for joint purposes or joint funds were borrowed against it, it can become complicated. This is why it is important to be clear in a divorce agreement regarding the classification of assets.

Table: Examples of Property Division

Type of Asset Example Typical Division
Joint Apartment Apartment valued at 2 million NIS, mortgage of 800,000 Equal division of equity (value minus mortgage), or sale and division of proceeds
Joint Bank Account 300,000 NIS accumulated during marriage Equal division: 150,000 to each party
Pension Fund Pension fund valued at 500,000 NIS Transfer of half the value to the other party's pension account, or financial compensation
Joint Business Business valued at 1 million NIS, both are owners Sale and division of proceeds, or one party buys out the other
Personal Property Inheritance received from your parents during marriage Remains personal, unless it is found to have been used for joint purposes

Spousal Support — How Much and for How Long?

Spousal support is a monthly payment that one spouse (usually the one with higher income) is required to pay to the other spouse. Spousal support can be for a defined period (for example, until the children grow up) or indefinitely (in certain circumstances). The amount of spousal support is calculated based on income, needs, length of marriage, age, health, and other factors.

Typically, the court uses a standard formula for calculating spousal support, but there is room for cooperation and agreement between the parties. I help my clients understand the calculation and obtain fair spousal support.

Custody and Visitation Rights — Parental Rights in Divorce

When there are children, the issue of custody and visitation rights is one of the most important in a divorce agreement. The Family Court always places the child's best interests at the center, but a divorce agreement can establish arrangements that reflect the wishes of both parents and the needs of the children.

Types of Custody

  • Sole Custody: One child lives with one parent, and the other parent receives fixed visitation rights. This is common when there is significant separation between the parents or when the child is more attached to one parent.
  • Joint Custody: Both parents share custody, often on a weekly or bi-weekly schedule. This requires good cooperation between the parents.
  • Alternating Custody: The child spends equal or nearly equal time with each parent, according to different schedules (for example, one week with one parent, one week with the other).

Visitation Rights and Contact

Even if one parent does not have custody, they are usually entitled to fixed visitation rights. This may include weekends, weekday evenings, holidays, and vacations. The arrangement should be detailed in the agreement to avoid conflicts.

Educational and Medical Decisions

The agreement should also specify who makes decisions regarding the child's education, medical care, religion, and social life. Often, both parents agree on "joint decisions" for major issues (school selection, surgery), but one parent may receive "day-to-day decisions" (what the child eats, what they wear).

Child Support

In addition to spousal support, the parent with higher income typically pays child support. This includes basic support (food, clothing, housing) and additional support (education, activities, medical care). The amount is calculated based on the child's needs and both parents' incomes.
